INTRODUCTION AND ACCEPTANCE
Welcome to Seconds! These Terms and Conditions ("Terms") govern your use of the Seconds mobile application ("App") operated by Secondsapp Limited ("Seconds," "we," "our," or "us"). By downloading, accessing, or using the Seconds App, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, please do not use our services.

DEFINITIONS
- "Account" - Your user profile on the Seconds App
- "Buyer" - A user who purchases items through the App
- "Item" - Clothing, fashion accessories, shoes, or related products listed for sale
- "Order" - A successful purchase transaction between a Buyer and Seller
- "Seller" - A user who lists items for sale through the App
- "Seconds Wallet" - The digital wallet automatically created with your account for managing payments
- "Service Fee" - The fee charged by Seconds on each transaction for buyer protection and platform services
- "Shipping Fee" - The cost of delivering items, handled by Seconds or our logistics partners
- "User" - Any person who uses the Seconds App

BECOMING A USER
3.1 Account Creation
- You must be at least 18 years old
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorised use of your account
3.2 Verification Requirements
To sell on Seconds, you must:
- Provide and verify your Bank Verification Number (BVN)
- Provide a valid billing address
- Complete any additional verification we may require
3.3 Seconds Wallet
- A Seconds Wallet is automatically created when your account is verified
- The wallet allows you to receive payments from sales and make purchases
- KYC (Know Your Customer) verification is required before withdrawing funds from your wallet
- We reserve the right to request additional documentation for verification purposes
4.
USING THE SECONDS APP
4.1 Permitted Use
You may use the Seconds App to:
- Browse and purchase clothing and fashion items
- List and sell your own clothing and fashion items
- Communicate with other users regarding transactions
- Access customer support
4.2 Prohibited Activities
You may not:
- Create multiple accounts
- List counterfeit, stolen, or prohibited items
- Engage in fraudulent activities
- Harass, abuse, or harm other users
- Attempt to circumvent our security measures
- Use the App for commercial reselling purposes
- Share contact information to conduct transactions outside the App
4.3 Content and Listings
- You retain ownership of content you upload (photos, descriptions, etc.)
- By posting content, you grant Seconds a license to use, display, and distribute it
- You are responsible for ensuring your listings are accurate and comply with our guidelines
- We reserve the right to remove content that violates our policies
5.
BUYING ON SECONDS
5.1 Making Purchases
- To buy an item, click "Add to Bag," review fees and total, then complete checkout
- All purchases must be made through the App, we offer various methods, such as your Seconds wallet, credit or debit card and any other payment method we may introduce.
5.2 Transaction Fees
For every purchase, you'll pay:
- Item Price: The seller's listed price
- Shipping Fee: Cost of delivery
- Service Fee: Seconds' fee for buyer protection and platform services (see below for details)
5.3 Payment Processing
- Payments are securely processed through our payment partners
- Funds are held in escrow until the transaction is completed

SELLING ON SECONDS
6.1 Listing Items
- Only list items you own and have the right to sell
- Provide accurate descriptions and clear photos
- Items must be clothing, shoes, or fashion accessories
6.2 Seller Responsibilities
- Schedule pickup promptly after sale confirmation
- Package items securely for transport
- Respond to buyer inquiries in a timely manner
- Ensure items match their description and photos
6.3 Prohibited Items
You cannot sell:
- Damaged items not disclosed in the listing
- Items prohibited by Nigerian law
7.
SHIPPING AND DELIVERY
7.1 Shipping Services
- Seconds handles all shipping and delivery within Nigeria
- For local deliveries, Seconds provides direct pickup and delivery
- For interstate and international deliveries, we partner with established logistics companies
- Shipping fees are calculated based on item size, weight, and delivery location
7.2 Delivery Process
- Sellers must make items available for pickup
- Buyers will receive notification once items are in transit
- Standard delivery times apply based on location
- Seconds is responsible for items during transit
7.3 Delivery Issues
- Report lost or damaged items within 48 hours of expected delivery
- Contact customer support for delivery delays or issues
- We will investigate and resolve shipping problems
8.
BUYER PROTECTION
8.1 Service Fee Coverage
Our Service Fee provides protection including:
- Refund Protection: Full refund if items don't arrive
- Quality Assurance: Refund if items are significantly different from description
- Damage Coverage: Protection against shipping damage
- Dispute Resolution: Mediation services for transaction issues
- Secure Payments: Protection against payment fraud
- Customer Support: Dedicated support for transaction issues
- Technology costs and transaction processing fees
8.2 Eligibility for Protection
- Protection applies to all transactions completed through the Seconds App
- Claims must be filed within specified timeframes
- Evidence may be required to support claims
8.3 Filing Claims
- Use the "Dispute" button on your order page
- Provide detailed information about the problem
- Submit evidence (photos, screenshots) as required
- We'll investigate and respond within 5 business days
9.
DISPUTE RESOLUTION
9.1 Reporting Issues
- Disputes can be raised from the order page in the App
- Contact us at contact@secondsapp.io for additional support
- Provide order details and description of the issue
9.2 Resolution Process
- We'll review all evidence from both parties
- Decisions are made based on our policies and available evidence
- Resolution may include refunds, returns, or other remedies
- Our decisions are generally final
9.3 Escalation
- If unsatisfied with our resolution, you may pursue legal remedies
- Disputes are subject to Nigerian law and jurisdiction
10.
FEES AND PAYMENTS
10.1 Service Fees
- Service fees are charged on each transaction
- Fees are clearly displayed before purchase completion
- Service fees are non-refundable except as specified in our policies
10.2 Seller Payments
- Sellers receive payment after successful delivery confirmation
- Payments are deposited into your Seconds Wallet
- Withdrawal requires completed KYC verification
- Withdrawal processing times may vary
10.3 Refunds
- Refunds are issued according to our Buyer Protection policy
- Processing times for refunds may vary by payment method
- Service fees are refundable in certain circumstances
11.
INTELLECTUAL PROPERTY
11.1 Seconds Property
- The Seconds App, logo, and brand are our intellectual property
- You may not use our trademarks without permission
- All App features and functionality are protected by copyright
11.2 User Content
- You retain ownership of photos and content you upload
- You grant us license to use your content for App operations
- You warrant that your content doesn't infringe others' rights
12.
PRIVACY AND DATA
12.1 Data Collection
- Our Privacy Policy governs how we collect, use, and protect your data
- We comply with the Nigeria Data Protection Act 2023
- We may share information where necessary
12.2 Communication
- We may contact you regarding your account, orders, or App updates
- You can manage communication preferences in your account settings
- Customer support communications are necessary for service provision
13.
ACCOUNT SUSPENSION AND TERMINATION
13.1 Suspension
We may suspend accounts for:
- Violation of these Terms
- Fraudulent activity
- Multiple user complaints
- Failure to complete verification
13.2 Termination
We may terminate accounts for:
- Serious violations of these Terms
- Repeated policy violations
- Legal requirements
- Business reasons
13.3 Effect of Termination
- Access to the App will be revoked
- Pending transactions will be completed according to our policies
- Funds in your Seconds Wallet will be subject to verification before withdrawal
14.
LIABILITY AND DISCLAIMERS
14.1 Service Disclaimer
- The Seconds App is provided "as is" without warranties
- We don't guarantee uninterrupted or error-free service
- We're not responsible for user-generated content
14.2 Limitation of Liability
- Our liability is limited to the extent permitted by Nigerian law
- We're not liable for indirect, incidental, or consequential damages
- Our total liability for any claim is limited to the amount of the relevant transaction
14.3 User Responsibility
- You're responsible for your use of the App
- You agree to indemnify us against claims arising from your actions
- You assume risks associated with peer-to-peer transactions
15.
LEGAL COMPLIANCE
15.1 Applicable Law
- These Terms are governed by Nigerian law
- Disputes are subject to the jurisdiction of Nigerian courts
- We comply with applicable Nigerian regulations including:
- Nigeria Data Protection Act 2023
- Consumer Protection Act 2019
- Electronic Transactions Act 2011
- Companies and Allied Matters Act 2020
15.2 Regulatory Compliance
- We maintain required business licenses and registrations
- We comply with applicable tax laws and regulations

FUTURE SERVICES
16.1 Planned Features
- We may introduce seller promotion services in the future
- Additional features may include post boosting and advertising options
- New services will be subject to separate terms or updates to these Terms
16.2 Service Changes
- We reserve the right to modify or discontinue services
- Significant changes will be communicated to users
- Continued use after changes constitutes acceptance
- Version history will be maintained for reference

19.
SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. Invalid provisions will be modified to achieve their intended effect to the extent possible under applicable law.
20.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and Community Guidelines, constitute the complete agreement between you and Seconds regarding your use of the App. They supersede all prior agreements and understandings.
By using the Seconds App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
